Pip Tribunal if absent was created by Jb
Hello, I have to send in extra evidence before the Pip Tribunal and spoke to someone there to find out what would happen of I did not attend. The lady said that it would go ahead ie paper based and that, as with an MR, there would be a risk of losing any existing award. I thought I read on here some time ago that if there was any risk of that, they or the Judge would notify you first. Or does that only apply if you attend the hearing in person? Thanks

If you are thinking of not attending then contact the TS and tell them, otherwise it could lead to further delay in a Decision being made.

If the panel is considering the reduction or removal of an existing award then they must contact the claimant, even if it is a Paper hearing that the claimant is not attending. The Judge will write to the claimant asking them to attend and the letter will include a statement along the lines that the panel are not bound by the existing award.

Thankyou. I am currently trying to write a letter informing them of not attending with reasons, ( I mentioned only a possibility on the phone). However, if I received a letter from them as you say, stating they are not bound by an existing award, would I have an option instead to just withdraw the appeal at that stage and stick with the existing award, as it were, as opposed to having to attend? I just don't think I can attend, having been to this place before and having deteriorated since my last visit. I suffer with agoraphobia on top of depression, so even a walk down the road can send me into a panic with crowds, plus I have no one on the day to accompany me.

Sorry, in addition to my question of if the Judge sent a letter saying they could not be bound by the existing award, could I just withdraw the appeal at that stage rather than attend? I also wanted to add that the lady advised I could ask for a postponement. Is that something you would not normally advise? I mean, it may give me time to get additional information but then again, I just want it over and done with really and I'm not sure I could even attend even if it was. Then they might see that as me wasting their time...

Your letter does not have to be detailed, all you need to say is that due to your conditions you do not feel well enough to attend and you wish the hearing to be held on the papers only.

If you are issued with a warning, not just a request to attend, then you can withdraw the appeal at no penalty to you.

Oh thankyou very much, that's a little more reassuring. I was considering withdrawing it completely at this late stage, even though it's taken a year to come up. Funny how the person from the Tribunal Service said I would receive no notice of any existing award in jeopardy and it could just get taken away. But then the man who was originally going to attend with me from an advocacy group told me that you had to attend and it could not be decided on papers... I lost all faith in him then to be honest and decided to try and find someone else to attend with but since have decided I just can't go through with it. Thanks again for your help.
