ESA and moving to an already UC area was created by FlemingWay
Hi there,
Gordon you very patiently reassured me that my Contribution-based ESA's IR top-ups EDP and SDP would not be affected when my current area turns into Universal Credit in December.
However it now looks as though this address is in jeopardy as the building may be sold. I have been invited to move to a shared house in Brighton which is already a UC area, and I would need to claim housing benefit (or the UC equivalent). This would put me squarely in the Universal Credit arena and I'm trying to work out what would happen then.
Would I still lose transitional protection of SDP and EDP (I know this is being challenged, but supposing I had to move immediately e.g tomorrow?) as it would constitute a change of circumstance? (I don't currently claim Housing benefit)? Would anything else happen e.g having to provide fit notes etc
Also is there any way to see what the Universal Credit application form and its questions actually looks like without (or before) doing it online - does it exist in any document format please?
Sorry to ask yet another question, I'm trying to coverall the bases and work out what to do for the best.
Thank you
FW

Nothing on this board constitutes legal advice - always consult a professional about specific problems

As of today, there is still no Transitional Protection for claimants having to claim UC, there are draft Regulations being reviewed but my best guess is that we are still several months away from these being implemented. The advice we have is that those who have already lost their Premiums will be compensated for this but how this will be done has not be explained and is dependant on the legislation being changed.
Your ESA award should be transferred automatically but this appears to be a manual process so we have heard of claimants having to provide Fit Notes while this happens.
I'm afraid I'm can't find anything about the specific questions you will be asked in order to make a claim for UC but the following does explain the information that you will need to have to hand.
