Hi all,
Just wanted to give an update on my xf from DLA MRC/HRM to PIP...No Award. I am sure like many more the standard of the decision makers rationale is to say the least...a disgrace.

I had a home FTF, didnt request one at home but thats where it was. 40 minutes it lasted with a One minute, yes...One minute physical exam.

I have nor yet seen the report, have asked for a copy, spoke to someone who looked at it in their department and said to me that as far as he can see the assessors report was favorable to me.

At this stage i am not really interested in what the assessor had to say or not say, I have already lodged a mandatory reconsideration (on paper), disputing the decision makers rationale alone outlining error after error after error after error.

Just to give you an example, DM to me in decision letter.......you state that you have difficulty reading and understanding signs/symbols. NEVER and I mean NEVER have I said that anywhere...I do not suffer any major depressive condition....My difficulties all arise from PHYSICAL conditions only. When i read this I couldn't believe it so I know for sure they did not read my case. There are a lot of other errors as well but don't want to bore you with all the details.

I rang them again today and asked why the assessors report which I requested had not reached me yet, surprise surprise NOT...."sorry no-one has actually sent it to you yet, I will definately send it to you today".

I have already indicated in my request for MR that if and when I receive the assessors report and if i find errors with that I will be in touch with them forthwith.

Do you know what, at this stage......I would not have any faith at all in this system and I am looking forward to an oral appeal tribunal where at least I know I will have the opportunity to present my own case to them.

Hi All

Just an update. Today I have received assessors report (disgusted) it is disgustingly incorrect, full of errors omissions and lies. Even down to the very time she arrived and left. (I have CCTV outside my house because we were burgled in the past) can easily prove when she came and left.

I have already contacted Capita Customer Relations (NI) and lodged a formal complaint (verbally), which i will be following up by letter. They advise me that they will have the assessor in to address my issues and should have a written response back from them within 10 working days from today. (cant wait).

I contacted SSA to advise them about complaint to Capita and asked them to hold off on my Mandatory Reconsideration( which already has been sent) until the issue with Capita is resolved. SSA advise me that this is unlikely to hold up my reconsideration because after Capita look at my complaint they may wish to send another assessor. I told SSA that I will never allow Capita into my home again, and I have absolutely no confidence in the quality of their work. This report is so flawed it should never have been used for my pip application and I certainly see no reason with this being the case that it allowed to be used with my reconsideration

If they try to insist that another assessment is necessary I will only agree if it is carried out in front of my solicitor and an independent witness. I have followed up this verbal request with a recorded delivery letter posted today by my husband. And we are now over the next few days put a written complaint to Capita so that I am sure everything is recorded in writing.

I will keep you updated with any developments........Keep fighting for your rights, its the only way this unfair system is going to change. Best of luck to all xx
