Hi my daughter recently received standard care and enhanced mobility for an ongoing period which we are really grateful for. However we are slightly concerned that the problems she has with communication (She is autistic and also has a diagnosed severe secondary social anxiety disorder) were ignored and she received 0 points for this in spite of having clear evidence to state that she had problems processing verbal communication and needed me with her to help explain things she did not understand (she has an EHCP). She does not talk with anyone unless I am with her helping. The assessor also wrote in most boxes that she did not have any cognitive impairments diagnosed which is not correct as she has a diagnosis of autism. I felt when the assessor came he had no real idea of autism and because she was able to repeat 3 words, spell world backwords and take away 7 from 100 a few times he decided that she had no cognitive problems.
My husband wants us to do a MR but I am worried that if we do this they may change the length of the award as the assessor only recommended a year and a half but the decision maker decided on ongoing and after July 2028 which is fantastic. My husband is concerned that because of her main communication problems and mixing with people (which she never does and has no social life) being ignored it may affect her chances with ESA. I don't know if this is correct or not.
She received 11 points for daily living (as the assessor did take account of her anxiety and depression problems) and 12 points for planning and following a journey so I was wondering if anyone knew how likely it might be if we did a MR they might reduce the length of award?given that the assessor had put a lot less time till review? We are grateful for the award but are baffled as to why the main problem, communication, which is what led to her anxiety disorder has been ignored. Her diagnosis is neurological differences including austic spectrum disorder and secondary social anxiety disorder. Thank you

There are no guarantees but we haven't seen anybody's award length changed at MR, in fact, members appealing specifically about their award length have had very little success in getting it changed.

Have you got evidence to support her need for Communications Support, a diagnosis of Autism will not be sufficient, even though this is a common issue for people with this condition?

Hi, we have a psychiatrist and psychologist report which we sent with the application which state the need for support with communication and also throughout her EHCP it detailed her problems with processing verbal communication and needing short unambiguous instructions. Because she answered 3 simple questions the assessor said she could communicate unaided for the majority of time which the decision maker quoted as why he had given her 0 points for this.

Make sure you understand and address the definitions for Basic and Complex verbal information, the bar is set quite high for this activity.

Hi Gordon Thank you. I will have a look. I had originally sent in evidence from her EHCP which stated ‘she has difficulties processing non-specific, ambiguous language; lots of information in one go; complex instructions containing two or more steps and unexpected or open questions’ The educational psychologist stated 'she likes the reassurance of her ‘(mother)’ being able to answer for her if she does not fully understand what is being asked of her’ Her psychiatrist also wrote that she was severely impaired by social anxiety borne of her social communication difficulties and also wrote a letter stating that he did not consider her capable of giving an adequate account of herself in an assessment because of her ASD.
Would this be enough do you think...although having said this they already have this information so im not sure if this would be enough. We do not have any extra evidence as I sent it all in with the application.
