You need to go back to the PIP activities and make sure that you understand the criteria against which your Daughter(s) are being assessed, you are not going to win an appeal arguing over whether some tests were done or not.

Have a look at our PIP Claim for the legally defined Descriptors.

on the report done by the atos rep which I requested , it clearly states that my daughter did the memory test , spelling world backwards , remembering a sequence of instructions , laying on the floor and doing the joint mobility test , yet none of that was done , the report goes into great detail about angle of movement of her ankles , wrist , arms behind back , strength of leg resistance to examiners hands whilst laying on the floor , none of that happened , we just went in sat on chair , answered questions , walked back out . the person even said she did not have her glasses on

I am quite sure that the tests were not done as you say but awards are made because the claimant has been shown to meet the criteria for one, you need to concentrate on this, panels are used to there being issues with what happened during the assessment, they will only be interested in your daughter showing how she meets the Descriptors.

first daughter went for new claim been awarded standard care , still waiting to go to court for loss of original pip , second daughter awarded standard mobility but due to her mental health would not allow me to ask for mandatory reconsideration , now first daughter on UC work related group even though under nurse practitioner for her anxieties and depression and on 100g sertraline , the assessor stated that because she receives this medical help that she must be willing to access help with how to look for work but incapable of mentally coping with being employed as yet . how do I word it for mandatory reconsideration or is there rules that might help to place her on care side
