esa appeal/UC was created by Julie1606
Hi,
My friend was previously receiving ESA which included the limited capability for work and was also assessed as having limited capability for work related activity.
Having been reassessed for ESA they received 0 points and therefore had to make a claim for UC. They have appealed the decision for ESA and have won, should they therefore now automatically receive the LCWRA in their UC entitlement. also this also makes me wonder, if you were in receipt of ESA and move to a full UC area, would the LCWRA be automatically awarded??

Yes, the LCWRA award should be applied to their UC claim but it usually takes the DWP 5-8 weeks to process a Tribunal result so they will need to continue to provide Fit Notes until this happens.

Any ESA award should be transferred automatically if the claimant has to claim UC.
