Hello please could someone help. I am trying to complete the PIP form and gathering neurologist reports since 2000. All reports have been consistent until My latest report after a visit to neurologist in August 2018. I didn't see a consultant but a assistant. The report I received 3 weeks later was very inaccurate saying I could do much more than I said I could and when compared with all previous reports makes out I have received a miracle cure for my ms. Also there are dates like medication dates, retirement dates etc that are totally wrong, which the report writer could have checked in my notes beforehand. I have contacted the report writer asking for the inaccuracies to be amended and pointing out how it appears I have been cured but the only response I had was a letter just repeating some of the inaccuracies at the end of each was written 'as stated by you in your email but not assessed. '
So now I have a report that makes me look very well and able to work full time as I did 15 yrs ago and a letter addressing inaccuracies that look like I have forced them to write they don't take any responsibility for.
I have contacted the report writer again and the professor as I can't accept this situation.
After being awarded life time dla, if these reports were sent to PIP I would not get anything, probably not even an interview, just told no you can have it you scrounge, go get a job.
I haven't been able to work since 2011, I need a full time carer but partner has to work or we couldn't afford to live. I can't go out by myself, I can walk to car with a stick but any further and I have to be pushed in the wheel chair.
Please what should I Do?

You seem to be already doing the right thing. Do you know anything about the email they mention?

Was it copied to your GP, if it was then it will now be on your medical records.

Hello Gordon,
Thanks for your reply. I saw the top Neurologist (my usual Neurologist) this week and he will prepare a report now he has seen me himself.
I had to complete and send the PIP form back to DWP a few days ago as my deadline is today and as I had 2 previous extensions, they would not have extended it again.

Yes, the inaccurate report from the hospital I complained about has already been sent to my GP, I imagine they have kept it on file. Clearly I do not DWP getting hold of this report but the new report that is being prepared right now.
Do you think I should I should take steps to retreive the incorrect report from the GP?
Will DWP contact my GP or the hospital for information about me without asking for my consent?
I supplied years and years worth of reports and evidence, so maybe this is enough?!

Your GP surgery is not going to let you remove information from your GP records, it's actually very unlikely that those assessing you will contact your GP but if you have included contact information for your GP and/or the hospital on your claim form then they do not need to ask for your permission.

Dear Richard,
Under the General Data Protection Regulation GDPR 25.5.18 you now have the right to rectification of records especially if they are causing you distress. If facts are wrong eg incorrect medication named, dates you mention you CAN have the records corrected. However if you disagree with a medical opinion you still can't force redaction/change but you can ask for a note to be added stating that you disagree with views.
Highlight the error on your copy of records, ask for them to be amended, ask for a copy of the amended records to be sent to you. If they STILL won't do this contact ICO. You might need help from CAB to push this through in a timely fashion.
I imagine you will need to contact records dept of Neurology dept. GP records usually have letters seperately from diary record so its entirely likely this won't be seen.
I'm afraid some assessments are done so badly that its very likely the HCP won't even contact your GP/ specialist, so your new report from the consultant will carry more weight. You can send additional medical evidence after you send the form.
Hope this is of use. If you've filled in the forms using this site this will give you the best chance.
You can also fill in the diary to show how your condition affects you on the majority of days, you can also send this in later.

Its very soul destroying when you have to fight those you have to trust most.

As the others have said once on your GP records its impossible to remove anything, I have tried and adding notes sometimes just makes it look worse. I even have someone else's records in with mine, name now redacted, with a note attached, but still there. Records that caused no end of trouble for me especially when applying for my pensions. A significant event was raised and investigation etc, the person whose records show me as physically fit as a fiddle, got compensation, I got several years of misery and an apology on the phone.

Now I get the records myself and send everything in linked and cited like some kind of hideous thesis. That way, hopefully, they won't feel the need to ask anyone else. My last assessment for ESA passed on paper.
