My mother is on DLA for mobility only, and has just been placed in a nursing home pending my father's recovery from an accident (a fall). He is her carer and she can't cope by herself, and at the moment he doesn't have the capacity to look after her after his fall, and that's why she is in the home. I would estimate that by the time she comes out of the nursing home she will have been in there for about three weeks or so. Both my parents are in their mid-eighties.

I am the Appointed Person for dealing with my mother's benefits, and I have two questions. These are:

a) Is DLA one of those benefits where you have to tel the DWP if the recipient goes into a nursing hime, and, if so, how soon do we have to tell them?;

b) If her benefit is stopped because she is in the nursing home for more than a certain aamount of time (like it is on PIP), does the benefit automatically get reinstated when she comes out, or does she have to reapply for it?

If your mother only receives DLA Mobility then their being in a care home should not affect their payments although you will still need to inform the DWP if their stay will exceed 28 days.

Thanks Gordon.

I am actually also applying for the care component now as she has dementia and is simply incapable of remembering even if she's put the kettle on. You daid the mobility component is not affected, but would the Care component be affected if she's in the nursing home?

If the Nursing home is publicly funded then it would stop payment of the Care component.

No that would mean that it's privately funded and she should still be entitled to the Care element.
