Entitlement to ESA backpay? was created by meechers
Hi Everyone,
I was transferred from incapacity benefit to contribution based ESA in February 2014.
In May 2014 I was awarded the daily living element of PIP but my claim wasn't reassessed, so I didn't receive Severe Disability Premium which I would have received had I been awarded income based ESA.
When my contribution based ESA ended in February 2015 after the maximum payment time of 1 year, I went back onto income related ESA and I did receive Severe Disability Premium.
Will I be entitled to a back payment of SDP that I missed out on from May 2014 to February 2015 as a result of being on contribution based ESA instead of Income based? Also, while receiving contribution based ESA I paid full council tax, prescriptions and dental charges which would have been free if I was in receipt of income based ESA.
Many thanks in advance, for any advice.

As far as I can see from your post the DWP should be contacting you about the missed payments, but with 10,000s of claims to review it may be some time.

If you do receive back payment then it will not cover any passported benefits or Council Tax reductions you will have to pursue these separately.

Hi Gordon,
Thank you for your reply. It's encouraging that there may be a chance of some backpay. I realize it will take ages, it always does when the DWP owe people money (they seem to be pretty speedy when it's the other way round though!!)
Thank you all for the great service you provide. I'm sure I wouldn't be receiving any benefit at all if I hadn't used your guides.
Best wishes
