A family member who suffers from severe mental health issues, was transferred to UC from ESA after change of circumstances when her partner found employment. The 'job' turned out to be 'slavery' and didn't last long, but that's another story. There was a gap between transferring from ESA to UC during which she received essential drugs which have been prescribed by her psychiatrist through her GP.
She has now received a letter notifying her of a £100 fine and a demand for repayment of the cost of the drugs. This has had a severely detrimental effect on her health and further increasing the financial problems brought on by the move from ESA to PIP. She has huge rent arrears and cannot find extra money for this fine.
Is there a way to avoid this charge ?

If there was a break in the benefit entitlement and they did not make alternative arrangements to cover the prescriptions then the penalty is valid but don't leave it there, I've seen posts from other claimants in a similar situation who were able to avoid the fine and just pay the missed charges by contacting the authority that sent the letter.
