what benefit can be applied for if Medical failed? 7 years 9 months ago #13553

Hi does anybody know what benefit can be applied for if a person fails a medical for incapacity benefit,i am really confused some say JSA others say ESA,OR INCOME SUPPORT? and can these be applied for whilst appealing,also does anybody know how soon the descision result is after going for an ATOS medical.

Hi Raymond,

Whilst appealing an IB decision it would be normal to claim reduced rate income support if you are eligible. Alternatively, it would be possible to claim JSA. It is also possible to put in a claim for ESA whilst awaiting an appeal decision.

It's just another of the ways in which the introduction of ESA has made life more complex for everyone.

We couldn't advise which of these would be the best for you personally but reduced rate income support would probably be viewed as the the most straightforward option by most claimants.

if you appeal against the medical (PCA)for incapacity benefit you can claim income support but will loose 20% of the personal allowance.

you can choose instead to make a claim to ESA which you can request to be backdated for up to 3 months (but you won't get it back dated any earlier than when the incapacity benefit ended)

you can of course claim JSA but you are making a declaration that you are fit for work and available for work
