Hi
This is my first post, I have just been refused DLA on the grounds of what my hospital doctor told them and my form, I have seen this gentleman once and his registrar once. I have SLE and my treatment comes from my GP who they did not contact.
I was honest about how it affect my day to day living which they have informed me I am able to do bathe etc without assistance untrue, prepare and cook a meal untrue,do not need help when going out untrue.
I made a claim for DLA on the suggestion of my GP and because I feel they do not belive what I have told them (and I sent all the literature regarding my condition) whether it is worth putting in an appeal, anyone had this problem?

Sorry to hear of your problems with the DWP. Have you asked for a copy of what the hospital Dr wrote in his report. If I were you I'd get this to see what was written to see how strong your case is and to hopefully be able to base your appeal on the problems he says you have and how these affect your care and mobility needs. I would definetly appeal as from my experience they routinely turn you down hoping you will go away and if you go to a tribunal in mine and a lot of other cases you win.

Thank you for the reply. I feel quite angry and upset especially when they are calling you a liar.I don't know what the hospital dr wrote, as I expained I have only seen the specialist once first time was someone draghted in to help with over load. I feel my GP should have been consulted as I deal with him regularly trying to find med that will help me(no success at the moment)
Thank you once again, I thought about just leaving well alone but I will speak to GP when I see hin next week.

Hi,

Have a look at this link and others on the same page about SLE in the DWP Specialist Guides. This is often used by DWP Decision Makers and Tribunals to help them decide entitlement to DLA.

Care and mobility considerations

I'd also advise that you seek help to prepare an appeal from your local CAB or similar advice agency or contact Community Legal Advice as SLE is very serious and often complicated disease.

Remember that you only have one month from the date of the decision to lodge an appeal., so I advise you to download it from here Appeal against a benefit decision (leaflet GL24)

Thank you for that, I will go ahead with my appeal.
The service you are offering is excellent best money I have spent.
Your encouragement and info spur you on to "go for it" I was realy ready to throw in the towel yesterday until another member replied a very helpful site.

Glad you are seeing your GP as like you say he is the one you deal with on a regular basis. I appreciate how angry and upset you feel at the momment but after being through the tribunal process twice I try and not to take it personaly. I know that seems impossible when there is so much riding on it but to the DWP it is just a game, they say your not entitled to DLA even when we are and it's down too us to get evidence from GP's and andyone else to show we are. But the most important thing is that if you go to a tribunal in my experience they will be kind and respectful and listen to you and how you are affected by your illness etc and its this that carries the most weight.
