Hi Steve

I agree with Jim there mine was the opposite way round they used my ESA medical in Jan when my DLA expired in May. They actually told me that they had taken that medical into consideration along with other information from my GP. I was very worried about that as i failed my ESA medical initially but the decision was overturned a week before the tribunal was due to be heard and was placed into the support group. In actual fact when my DLA was due in May they actually increased my DLA award.

So its not always bad news but i know that wont help you at the minute. Wish you all the best and i will keep my fingers crossed for you.

sorry if this turns out to be wrong but i was under the impression if u had high rate care from dla you are exempt from esa medical if was you id ring up esa and point this out before you go to tribunal if not ring the tribunal and inform them.

I believe that the exemption for people on higher rate DLA applies only to IB not ESA. It is one of the things that people have been campaigning on.

Hi survivor

Thats correct you are only exempt when receiving IB i have already made that call because i am on ESA. Being on HRC is totally irrelevant they dont take that into account.

Hello All, Not long got back from appeal hearing and totally shocked at the way they are conducted. First the judge was so in my face it was unreal then the doctor who was a police doctor by the way had the nerve to say that because i did not have deformed hands / fingers then it cannot be that bad ( i have rheumatoid arthritis). i was made to feel that i was wrong in having a disability in the first place so angry but kept control, asking me questions about 10 months ago did not help either. Needless to say i dont feel very hopefull as thay say will post me verdict and will get tomorrow.

Hi Steve,

So sorry to hear that it was so bad for you. I have been waiting for an appeal date for DLA, I think I will switch to a paper one as I couldn't handle the stress if it was anything like that when I went. I can't handle the stress just with the paperwork, the thought of being face to face with someone like that terrifies me.
Can you appeal again if it isn't a good result? Although until you get it in black and white you never know. Hopefully you will be pleasantly surprised.
