Hi everyone,
I am new here so i dont know if i am doing this right. I will try to keep a long story short, I was in 2 car accidents in 2007 since then i have back, neck and psychological problems. I was claiming ESA but was unable to go to the assessments due to aniexty/ panic attacks which i explained to them and provided a doctors letter(£15 charge)to varify my physical and psychological disorders i also attached a copy of my 2 MRIs.The ESA sent me a 3rd WCA on the 24 Sept 10,i did not go to the appointment and did not inform them because i forgot/ got confused. I explained that meds that i am on impair my mental state such as memory, cofusion and motivation but they stopped the benefit from the 25 Sept 10 which they informed me in a letter on the 22 OCTOBER 10 i am now Appealing against the decission i was told by the ESA to claim JSA in the meantime but my doctor has signed my off sick, what am i allowed to claim ?? i thought to claim JSA you have to actively able to seek work and that it was not allowed to work when you have been signed off ill by your Doctor??

Hi,

You have been misinformed by JC+. You should make a fresh claim for ESA straight away.

The reason you were refused ESA was not because you failed the WCA but because you failed without good cause - in the DWP's opinion - to attend a medical.

So, make a fresh claim and try to arrange to have a home visit for your medical or get support to get you to the medical.

Good luck,

Steve

Hi Steve,
Thanks for the advice I am in the process of applying for ESA (again)In the GL24 "if you think our decission is wrong" appeal form i have put that "due to my impaired physcal, psychological medical condition and the medication that i am taking i find most days difficult to carry out normal day to day activies. This is the reason why i was unable to attend and inform of non attendance of the WCA on the 24 Sept 10. My condition/ circumstances have not improved since the previuos appointments sent which i have provided evidence of my conditions this is the reason why i disagree with the decission".
Do you think that is OK??

Hi kmr,

It certainly sounds like sufficient grounds to have your appeal heard.

Good luck,

Steve
