Can tribunal clerical errors effect my appeal

Many thanks Jim & Co.

I've requested the TS re-send the paperwork appended onto the exisiting numbering system, but if they fail to do this then I will point it out at the appeal.

Hi Doris,

If it's any consolation, it was pretty common for DLA Tribunal Members to receive case bundles which were numbered incorrectly.

However, we used to just piece them together ourselves, and I personally can't remember us adjourning just because the case papers weren't number precisely.

I'm going to need it !

Original DLA application was well over two years ago and the EMP report was well over a year past the initial claim.

I'll be working in a time vacuum as to my condition back then, and their ( meaning the Tribunal Panel ) interpretation of my condition now ( some 30 odd months on ).

sounds familiar Doris, 4 yrs ago I applied for an appeal with DWP for housing benefit(I had moved home to be nearer my carer and needed a downstairs toilet) and asked for an oral hearing as I was not well enough to attend in person.
I never won but they sent me a copy of the papers and some were missing. The ones that were missing were the DWP leter of my DLA award, it was itemised as p.9 but there was no p. 9.
I contacted them and got told it was def in my appeal papers but found out after a long investigation, it was not. Who deleted this info I do not know. This info. let the appeals board know I was on DLA indefinitely and would explain my move of house. So in answer to your question Doris, the DWP do seem to misplace papers that ARE VITAL IN A HEARING.
