DLA Appeal info please

Tom she might need her DLA but the lady down the road might not have given you the full picture ? even the dla people dont pull names out the hat and just stop benefits I think the leave that to the IB department) ;)

I mean that just because someone says something without all the facts its hard to judge

People post on here about friends and relatives needs, so knowing them you have a good idea of there problems..... but toms post is one up from talking to a man in a pub

he says nothing about if she has had a review or if someone has reported her... the way he has posted its as if her names been pulled from a hat (i did not think that was coming in till next year) ;)

Hi Dave,

It sounded as if you were being judgemental, which I'm sure wasn't your intention.

Without all the facts, we cannot judge whether a claimant is, or is not entitled
to DLA, which is why always say we cannot give advice on individual claims.

Presumably if the 'lady down the road' has been in receipt of DLA for 8 years,
but has had it terminated, that doesn't mean that the Decision Maker has made the right decision to do so.

My advice unless the lady's condition has improved, would be to appeal using
Appeal against a benefit decision (leaflet GL24) and to seek advice from her local CAB. If they can't help then she could try Community Legal Advice

I am not being judgemental of the lady, my comment is more the way tom has posted the statement.

we get many posts where payments are stopped or cut and enough info to know there is a big question mark over whats happned. but in this case it has so little detail. it could worry some people that the DWP are even bigger ***** than they are :)

Hi Dave,
sorry if it was not to clear but it was just a quick question to see if anyone on this site has had this done to them.
I will pass on the advise on here so thanks to all.
I have my own battle to fight now. I put a post on this site about 3 months ago telling how I had won my appeal (ESA) and now today I have been sent another questionnaire about limited capability for work. It seems to me that if they loose first time up they are more than willing to spend tax payers money in the same merry-go-round again. Form/Atos medical fail/appeal.
It seems to me that when the judge has made there judgement and it don't go the way of the DWP they can arras you at will, but if you lose you cant make another claim for 12 months. How is that right.
Oh well here we go again.

many people seem to get the form after winning .....I hope you see what I mean about a man in the pub ;) there is lots of bad news out there regards benefits, its just your comment on that lady was to me likly to worry many people who are all ready very worried most comments on stopped benefits I have seen here are qualified without going into personal details.. for example after a medical or someone reported me

had she been reported or had a medical ?
