I put a post on this site about 3 months ago telling how I had won my appeal (ESA) and now today I have been sent another questionnaire about limited capability for work. It seems to me that if they loose first time up they are more than willing to spend tax payers money in the same merry-go-round again.
It seems to me that when the judge has made there judgement and it don't go the way of the DWP they can arras you at will, but if you lose you cant make another claim for 12 months. How is that right.
The DWP seem to think that if you fail the ATOS doctor medical that should be that. They dont seem to be able to get it in there heads that its a system which makes ATOS lots of money if you fail.
Oh well here we go again.

Sadly, this seems to happen to quite a lot of people who win an appeal. Good luck with your medical.

I think the problem is that ESA is a complete lottery. If you have two WCA medicals on the same day with different doctors, you could well score 30 points in one medical, and 0 points in the other, 0 points being more likely.

Whatever a tribunal judge decides, from the DWP's point of view, it's worth another go. :angry:

:( i recently after 21 years got took off my e.s.a. i appealed,waited10mth,went to appeal went in with nil points,won,got 27points and put into work rlated group,again in aug went for another medical again got nil,now waiting on appeal date,w.rights hope d.maker will overturn it, dr cnt believe it,so there one example,my heads dun in with it all i feel like just doing what they want,i sometimes think is it worth it when i know there is no way i could claim j.s.a as i,m simply not able and fit to seek work,at wits end,hope all go,s well,i think you get a better deal when you appeal.

Hello,
At least you got ESA 50 Medical Questionnaire. DWP Decision Maker sent me straight to my second WCA after winning my Appeal.
The Coalition Government should terminate all welfare benefit and sack all DWP staff - the savings would allow MPs expenses to be vastly increased to compensate them for all the hard work they have to undertake

Don't ever give up Cstewart, that's what they want you to do. When the doctors tell you your too sick and when an independent judge can see its true then who are these faceless toe-rags who think they can take away our rights.
Keep fighting and never give up or as Rab1000 puts it they will have more money for them and there pet projects including large bash dinners with there tax aviation mates who are probably they same people who are sending all the jobs to the far east.
I look around my home town and where once there was streets full of firms employing thousends of workers now its just dereliction. Who fault is that, not benefits claimants or unions. Its been poor leadership more bothered about how to line there own pockets and now this once great land is in a big mess (one town cant even afford christmas lights) that's what we have come to.
Never give up Cstewart have a bit of the Dunkirk spirit and lets fight on.
