I cannot see why you have received an ESA50 form, by you own admission you are in receipt of SSP and you are still technically employed, both of which disqualify you from receiing ESA.

The accompaning letter should give you details of the JobCentre Plus office handling the "claim" I would give them a ring and ask for their opinion. :)

Hi
It's possible to receive ESA whilst you are still employed as I found out earlier this year. Your employer pays you Statutory Sick Pay (SSP)for a set period of time and when that runs out, they send you form SSP1 which you fill in and send to Jobcentre plus. This is your application for ESA. It's either contributions based or means tested. You will be on the Assessment rate for up to 13 weeks by which time you will get an appointment for medical assessment by Atos Origin. I found it rediculous that I had to go through all of this while I was still employed. Needless to say I failed the medical and went back to work for financial reasons and within 3 weeks was signed off again and now I'm going throught the whole business again. Hope this helps. :)

sorry gordon i seem to have confused you i will start again. i recive 60% of my salery less ssp. i phoned the dwp and told them that i no longer recived ssp from my employer,and they granted me £65 a week from august. i send in fit notes every 3 months to dwp and my employers. the 60% is paid by my companys insurer.my question is how does the esa form apply to me as i am not unemployed and if it does what group will they put me in.
ps the insurer will review me again in july.
