I have osteoarthritis of the spine (neck) and shoulder, with poss hips and knees,elbow and wrist. I have just failed my medical scoring no points. Unfortunateley did not come accross this site until i had been for the medical. I was told by telephone call on the 8/12 and received letter 13/12, i have appealed and returned it today. What i want to know is their anyone who has been awarded esa with osteoarthritis, and how do you go about attaining proof of your illnesses, my doctors not very forth coming, and also i immediatley reapplied for esa, will i get it from the 8/12 or from the day they receive the appeal or will i have to wait annother 3 waiting days, sorry for all the questions, but live on my own and have no income whats so ever.

Hi ccactus

ESA is not based on your illness but how your illness prevents you to complete activities. Please read the ESA guides in the members' area, including the appeal guide, which gives advice on obtaining and submitting evidence.

There is no need to make a new claim for ESA. You simply state on the GL/24 form or appeal letter that you wish to be paid ESA assessment rate pending appeal. Your payments should continue until your appeal date, and be backdated to the date that payments stopped.

You cannot normally claim ESA within six months of failing an ESA medical, so your claim may be rejected, but your original claim should be reinstated when they receive your appeal. I would suggest that you contact JCP to confirm that this is the case.

Thanks for your advice Depressed Derek, I will check it all out, I was just wondering if anyone out there had the same complaints as me, because the questions I had did not seem relevant. Cheers.

Absolutely, their questions have no relation to any kind of reality whatsoever! May I suggest that you visit your local CAB and see if they have a benefits adviser available, or a law centre, because they are well informed to navigate you through the lunacy which passes for the Atos test.

Hi

I too have Osteoporosis but it is caused by the excessive steroids i have had to take for the last 9 years due to severe Crohn's Disease. You must have had a bone scan to diagnose your Osteoporosis so a copy of the report should help. You really need to explain in detail how it affects your mobility/daily life as for ESA they are looking at what you can do not what you cant. During the damp months i suffer badly with the pain in a lot of my joints although the Osteoporosis is only in my hip and spine, so i guess the joint pain is coming from IBD, as is the Diabetes and high blood pressure.

Is your Osteoporosis secondary to another disability or not? If you are appealing then when you complete GL/24 tell them you want to continue recieving ESA at assessment rate.

It is difficult for some members to read your posts when you write in capital letters and comes across as shouting!!!

also why is your dr no help ? you talk of getting proof ? what is he writing on your fit/sick notes is your problem ?

is it a disagreement of whats wrong or is it how ill you are ? you might need a new dr :)
