It really is completely non sensical but Survivor is right.

For example, my tribunal on Monday could say I was not fit for work, then in theory, the next day I could receive another 'invitation' to a medical assessment.

The tribunal would have been saying I was not fit for work on July 21st 2010 (or whenever it was. Unless of course, they put in writing, "and will not be fit for work for the next x months".

Incap - I think you need to get face-to-face advice from a legal adviser before pursuing this further.

If you are right, this may involve a different course of action from appealing the fresh decision.

i totaly agree with you my friend.

however in my case a court of law made a order that i am exempt, there is no ifs or buts about this, a court of law has made a rulling, that rulling is that i am exempt and suffer from a server mental illnes as defined reg 10.


the sec of state does not have the legaly power to over turn the courts rulling that i am exempt.

im contacting the appeals service as we speak to try and see if they have any opther paperwork.


in a respnse from the jobcentre, they state "it appears your exemption will last 3 years"

notice the word appears, the jobcentre can not say for fact that the courts decison only last for so many years.

they are only making assumptions.

I think your stuffed as often the court you talk of find in favor of others on IB and ESA and within days they are sent paperwork to start again?

I think somewhere in the small print the DWP will have this well covered
