Who do you listen to.?. was created by Dee
Well I am confused, I recently requested an appeal regarding my DLA I had High, High and it was reduced to just low rate care no mobility. I appealed, I produced evidence from the GP, Drs and other sorces. It was sent in 1 day before end date. I was told that it was pulled from going to appeal on the evidence that I supplied, and I was now awarded High mobility - indefinite ( or until they decide otherwise) and low rate care.
I suffer from ME IBS FBS Chronic back pain and depression, there are other thing too but I will not bore you. My care has not changed, expect may be I am able to do things for myself, personal things that you do yourself.

I was told not to ask to look at the decission again as I would loose the mobility, which is the higher amount, to leave care alone, after 6 months re-apply for care, but the mobility will be looked at again. I could loose it and then have to start the whole process again. I feel this is unfair you either need it or not. I would not apply for something that I am not entitled to. The Dr they sent, reported that he thought that I could do more than I was letting on, how dare they make assumptions. What do I do, keep ringing the DLA and reporting my condition has changed, writing to them with every little detail. Stress, I am so stressed I feel like screaming. I get told well you dont need it, or you will be cared for anyway, but that is not the point.

Is there any one who has had the same problem and has overcome it? Please get in touch.

It is true that if you appeal a decision where you have awarded DLA, your whole application is reconsidered and therefore you can lose what you have been awarded. This is certainly frustrating to say the least. Indeed, my personal view is that it is unfair, nevertheless, it is how it is.

Therefore, you have a very difficult decision to make as to whether to appeal against this revised decision and sadly no one can tell you what you should do. I don't think it's a position anyone likes to be in.

If you want further food for thought on this, take a look at our guide to DLA appeals in the Help for claimants section.

Please do be aware that you have to appeal within time limits and so you mustn't take too long over your decision.

hi i am in the same predicament as you and feel really angry that they could take away my high rate mobility as i am asking them to look at the low care again - even tho last year got high on both - surely the decision makers need to do more training to decide what goes and what doesnt - how the hell can one say yes and another would say no????...baffles me - perhaps they decide how many they will say yes to each day and stick to that....who knows but personally i think they do what they want.....xxx
