The award period is the result of an an opinion by a Decision Maker, being an opinion I would suggest that it is not legally binding.

It wouldn't be retrospective because they wouldn't be taking away monies already paid.

Also even if they decided not to remove an indefinite reward, there'd be nothing to stop a government reducing the rates to zero, so you had an indefinite award of nothing. There's generally a legal way of doing most things the government wants to do.

Thats something they have done for ages with War Pensions they find you have something wrong but give Nil Award of course you can have them look at it again in the future

these changes have been in the pipeline even before the ConDem pact. When awarded DLA in 1995, it was 'for life' . I guess we did not die quick enough so the wording was ammended to 'indefinite'. That gives them a lot of wriggle room! Also.. I was 'exempt' due to incurable condition that remains unchanged....but now just praying to at least be put in 'WRAG' . Anything else will be a bonus.

these days incurable condition means bugger all with the advances in drugs and treatments anything is possible, that said the NHS has not got the money for plasters so no chance of getting many of the new treatments in the next 5 years

Try telling a terminally ill person with an incurable medical condition that "anything is possible!"
