IB Confused after sending in IB50 was created by Lorraine
Hi,
Sent in an IB50 at the end of November after being asked to do so. Been getting IB for about 6 years now.

Was told the following (well think this is what they ment). As all climants of IB will be reassisted between Oct 10 and oct 2014 things are chaning.

My form is still being processed. If I have not heard anything by March they will stop looking at my current IB50 and send me a new one (mucher harder and trying to get people off it I expect) and then a phone call.

So do you think I am right in thinking that they will not process my current IB50 and leave it a few weeks and then send me the new form and the I will have to go through all the hoops again and most probably have a medical?

I know things are changing for all benefits but may I ask what people know if anything about the new IB process and people like myself still claiming?

Have looked up things now (should of before sorry) and I am more clearer. Think I am sure to have to do new form sooner, but will see.

One question: people like myself that have been getting higher rate for age etc at £90 something a week - will it go down to the £65 a week while we are being assessed for the 13 weeks etc or stay at the present of over £90?

AS I understand it, you will continue to receive the IB rate until a decision is rendered.

If you were sent and returned an IB50, i think it would be unfair not to review you under PCA rules - especially if you went on to fail the harsher ESA medical and forced to appeal.

Having said that; an early transfer to ESA could be financially beneficial to those put in the support group.

As long as you pass the ESA medical you would continue to receive the £90 something (more if you were put in the support group). The 13 week business does not apply to IB claimants being migrated.

However, anyone who fails the medical would be forced to either sign on for JSA or start the appeal process. This would involve claiming low rate ESA until the appeal is heard, and going back to sending in sick (sorry fit) notes. The difference between the low rate and higher rate is backdated if the appeal is successful. Both JSA and low rate ESA are £65ish.

Whilst on the issue of delayed reviews -

Just over a year ago, following a lengthy investigation into a complex complaint against Jobcentre Plus and Atos Healthcare - the Parliamentary Ombudsman deemed my drawn out IB review to be maladministration and recommended Jobcentre Plus pay compensation for the distress caused.

I personally think that the lack of any proper notification to claimants about changes in the way IB claims have been processed over the last year also mounts to maladministration.
