Hi all,
Won my tribunal Aug 2010 against being put in wrag group, put in support. Just been sent a new ESA50, would I be right in thinking as my condition has got worse, this report is still vaild. Also I was put into the support group as I needed supervison, and I was a danger to myself and others, can I ask to see the tribual written reasons for there descison, to attach to my new ESA50. I also suffer from heart disease.
All advice appretatied, sorry about spelling brains gone loads off stress.

You need to contact the Tribunal Service and ask for the Statement of Reasons from your Tribunal.
Certainly any previous reports will still be relevant, but I am guessing that they must be at least a year old by now, so you will need to address how your condition has worsened since the original Decision (not the Tribunal).
Also, you need to check your ESA50. It is very likely that you will have received the new version (dated 03/11 on the front page). Most of the tests have changed, especially in the mental health side. Our guide to the new Physical tests is already in the Members area, the Mental Health one should be available in the next couple of days.

hi,
Thanks for that Gordon, I requested the they send me the old ESA50, which they have. I will also be approching my doctor, on another point Gordon when I rang DWP asked why I had beed sent new ESA50, told me that it was ATOS who do this, rang ATOS told me it was the DWP who do this. So put complaint in against both:))

Hi , I just want to say thank you very much for all the help and support you all give on this site. I have just got my dreaded brown envelope today informing me my DLA will continue at my present rate ( high mobility and middle care ). I have had a stressful 10 weeks waiting since I filled my forms in but the relief now is overwhelming !
To anyone else having to fill a form in I advice to take your time and go through all the advice available.
