1a) The appeal system is changing next year in that the claimant will first have to ask for a reconsideration and then go to appeal afterwards if neccessary. There will be no payment of ESA during the reconsideration period if the person was orignally refused ESA.

1b) Legal aid will be withdrawn for benefit appeals next year.

2) Your guess is probably as good as mine! :(
