It's a good question, John, but I suspect you're asking a 'biased' sample of people (statistically speaking) as those who've been awarded ESA are far less likely to be visiting this site.

I wonder if anyone has put on a Freedom of Information request to get stats on pass rates of Old vs. New tests.

On a related theme, can you complain about the inaccuracy of your ATOS medical report? I see so many posts about how rubbish the reports are - mine was just awful. If only there were a way to affect official stats somehow. So we could see "65% of claimants say their ESA85 contained serious errors of fact" or somesuch.

I venture to suggest that if figures were obtained now, they wouldn't be very meaningful statistically, because it's only a couple of months since the new WCA came in. I don't think that the stats get published that frequently. However, if anyone does have the stats, it would indeed be interesting.

You can complain to Atos, but if the tribunal becomes aware of your complaint, they may delay the tribunal hearing until after the complaints process is concluded.

:ohmy: Classic Catch-22. "Of course you have the right to complain. But no-one is doing it which shows all's well. What do you mean they don't want to delay their appeal? That's idle speculation!"

Where can I get more info on how to complain, and how it affects my appeal? (For example, suppose the complaint is 'rejected' or 'not upheld' or whatever the terminology is - would that influence the tribunal?) :dry:

I can't help you on that, I'm afraid (not my area) I just picked up on what I said in my above reply from something elsewhere, but hopefully someone will come along soon with better knowledge of this area than myself.
