I am a carer for my friend, she is on IB at the moment, she will be sending in her ESA50 and is worried if has medical and is put in the WRAG group, can she appeal to go into the support group and if so how and will she lose benefit if does so, can anyone help me here as she is making herself so stressed with worry.

Yes she can appeal to be placed into the Support Group, she will need to provide evidence that she meets one or more of the SG criteria.

However, she needs to be aware that appealing in this situation will lead to a re-assessment of her whole claim and that can on occasion result in the loss of any existing WRAG benefit.

Have a look at the ESA Appeals guide in the Members area.

I think it's really unfair that if you appeal against being put to the WRAG that your re-assessed and it can result in the loss of any existing WRAG benefit.
How do they get away with it? Makes my blood boil, just another way of putting you off appealing.

My sister-in-law had higher rate mobility and lower rate care for dla. On re-assessment was awarded lower rate for both. She appealed and lost. Her dla was taken away and she lost her mobility car. Eventually with the help of her doctor, who attended an appeal for her in person, she was given back her dla at the orinigal rates. I would assume esa is no different. Appeal and you stand the chance of losing what you have been awarded but with the help of the right people there is justice!

Given that people are often reassessed frequently it might be worthwhile sitting it out till the next medical comes along. It probably won't be long.

Thanks for the rely, just think its so unfair to penalise people for appealing because ATOS cant see that someone is really ill. Fingers crossed she gets her assessment and gets put in the support group.
