I am technically self employed as I have a smallholding with my husband which makes virtually no profit though we have to continue with the livestock & land etc. My husband does gardening to bring in money and untill last autumn I was also working full time. I had to give up my job through stress/anxiety & depression, my doctor told me that I could work limited duties on the farm but with no dealings with people. I was working 18 hours on the farm, my husband 50 hours until April. I then tried to claim ESA, I didn't understand the form and filled out both parts, eventually they asked for us to fill out a self employed section - they then told us we were working too long hours to claim... nothing else. By this stage my condition had worsened and I am unable to do basic things around the farm - I am not working, I am told to fill in a new form, which I have now done, exactly the same again only now having done this in a seperate letter I have been sent a leaflet which says that the hours my husband works will be too much for the income based ESA. I'm already struggling with these forms, I have paranoia and anxiety, and I'm scared of getting this wrong... I don't want to ring them and I've no idea what an ESA50 is should I have been sent this already... really struggling here :(

From what you have said, it would appear that your ESA claim has failed because you did not meet the basic conditions of entitlement, irrespective of the medical aspect of your claim.

It would be in your best interests to consult a local CAB or welfare rights office to seek face-to-face advice, to discuss whether an appeal should be made against the adverse ESA decision. This will take into account both your own personal circumstances and those of your husband, which cannot be discussed in detail in an open forum.

I do believe one of the conditions to be entitled to ESA is that your partner has not to be working any more than 24 hours a week. There are many other conditons too. Crazydiamonds suggestion of seeing someone at your local CAB or welfare rights office would beo the logical next step. I hope you manage to find a resolve.

Found a day my head could cope with to ring them... the office dealing has moved from the south of England to Scotland, they've lost my form and want me to start again! :( :angry: :S

Hi Dizzypip

As crazydiamond said you should get specialist advice from a welfare rights agency such as a citizens advice bureau about your entitlement/claim. They are in the best position to look at your circumstances and assist you.
