DLA awarded now ESA medical was created by clearwater
Steve and B&W thank you for all your info.Posted my DLA renewal claim 3 weeks ago, quick decision, yesterday awarded LR mob & care for a further 5 years, I applied 2 years ago and was awarded for 2 years LR Mob & care that ends shortly.

I am filling in ESA50 forms Pt 2 Q11-17
would my being awarded 5 years DLA
for MH reasons having any bearing at ATOS medical, I am on IB currently?

Should I fail ATOS medical does it impact my DLA award can they change, amend or rescind the award?

Hi,

DLA is a benefit paid to claimants who have mobility and/or care needs arising from an illness or disability.

IB and it's successor ESA are benefits for those who are unable to work due to illness or disability.

I know many who receive DLA who manage to work both part-time and full-time. I did it myself for nearly 10 years, but my DLA was never interfered with.

However, regretfully Atos Medical Assessors sometimes don't appear to know the above information.

An Atos Medical Assessor cannot remove your DLA, only a DWP Decision Maker (DM) can do that. Although it has been known for a poor Atos medical assessment for IB/ESA to lead to having a DM reduce or remove a DLA award, although from experience, it's usually reinstated when the claimant appeals to a Tribunal.

I wouldn't worry too much about losing your DLA, simply because you have an Atos medical, it only happens in a small number of cases.
