As far as I know there is no time limit for making a formal complaint to Atos, but it would be advisable to do so as soon as is practicable, otherwise there may be a suggestion of delayed afterthoughts and possibly an allegation of sour grapes.

hi anne. i also had the same kind of report back from atos which was to say the least was pure fiction.has anyone out there had a true report from atos or maybe its us that are all wrong?

It seems likely that the "pure fiction" will continue unabated until such time that the compulsory recording of medical assessments occurs, but this evidence will prove extremely troublesome for the purposes of removing claimants off sickness benefits, so I have serious reservations as to whether it will ever happen beyond the now completed pilot stage.

Preparation for Medical Assessment is half the battle

1. Make sure you have a good relationship with your GP, or one at the practice, the slightest doubt over their empathy then try and get a new GP

2. Keep your health carers aware of your difficulties.

3. if you can, for a period prior to your assessment, keep a diary if your daily activities and difficulties This may help you focus on what yuou might say as well as be useful in the event of an appeal later

4. Know the criteria for ESA and make sure you truthfully describe your problems in the light of the criteria

5., Complete the medical questionnaire with care, and in detail, and if you have helpful supporting evidence enclose it (not matter what ATOS OR dwp SAY )

6. Keep a copy

7. Take a friend, carer. or suppirt worker, to the assessment

8. Do not put on a brave face, if it does, or is likely to hurt, then refuse to perform the requested activity, and do NOTY hide any anxiety or fear you feel
Do NOT allow the assessor to rush you

9. At the end, if you were unhappy with the way it was undertaken, complain immediately, in writing, to ATOS

Hi Brian,
I have to say that my first medical report went very much in my favour, in fact the doctor put things in the report she hadn't even asked me and actually made me sound worse than I was at that time but it was a month before I was due for spinal surgery.
I just noticed this report stated I have no problem with leisure activities (stated I can sit and listen to music.

I may not be the brain of britain but the word 'Activity' means to move, to be active. How can listening to music be an activity? Sitting is an inactive thing and music is a hearing thing so technically I am inactive if Im sitting. This is going in with my Atos complaint, see if they can clarify what they mean by 'activity lol!
