after waiting almost 1 year today was my tribunal to say it was unpleasant is an understatement and after an hour of grilling on the aspects I was disputing which all hinged on bending to touch your knees I had said that because of my condition of spinal stenosis (of which the assessor had said I did not havebut was agreed today was a mistake) osteoarthritis disc disease including prolapsed discs I could not bend to be told we know with your conditions you could not fully bend forward but surely you can bend acouple of inches to touch your knees I replied I could but it was painfull and not something I would choose to do needless to say my appeal wa dissallowed although I went from 0 to 12 points how is this going to help me when Iwas told this the judge said that it would help if I claim job seekers as I would not be able to do jobs involving sitting standing driving or lots of walking so where does that leave me on the one hand they say this but basically they have said you are fit to work Ido not want to go on j/s is this is agreeing with them which I dont even my consultant had written stating that he was very concerned that I have been told I could do normal work as this would have a destabalising and deterioating affect on my condition and would cause flare ups of intense debillatating pain and work would not be sustainable but hey he is only a orthopeadic specialist where do I go from here I feel its pointless trying any more

I'm sorry to hear that your appeal has been disallowed and I agree that scoring 12 points is little consolation.

As it's been almost a year since the decision you can make an immediate claim for ESA again.

I had a similiar situation, i wasnt getting a lot of support from my doctor, so i changed doctors, and now awaiting for the statement of reasons from the appeal tribunal. so much for caring britain.

This really sounds wrong as being able to bend, a little or a lot, isn't indicative necessarily of whether or not you've got a back problem. If you can't stand for long or sit for long and that's accepted by the tribunal as you seem to suggest then surely you'd fit the relevant descriptors anyway without any unecessary and irrelevant reference to being able to bend. They might as well determine the state of your back by the colour of your hair.
