what would happen if your esa is decined due to o points after atos medical and appeal turned down so you had to apply jsa and once accepted on jsa you sent in new sick note stating you are unfit for work would this be a new claim for esa

Hi Steve

Yes, it would be a new claim.

You are entitled to reclaim ESA and get paid at the assessment rate six months after the DWP decision (not the appeal hearing) to stop ESA or earlier if you have a new or significantly worse condition.

If you don't have a new/worse condition, you can still make a claim for ESA before the six months are up but you won't receive any payments until the six months have expired.
