Filling in esa form was created by helchis
Ive got my esa form to fill out but need help doing so but cant get to see a welfare advisor for 6 weeks,if i phone dwp is there a chance i may get the date i need to get the form back extended.i just wondered if any other members have had this problem

If for whatever reason you cannot return the ESA50 by the deadline date, you should contact Atos and/or the DWP immediately to request an extension of the time to return the ESA50.

The decision to grant an extension of time may well depend on the circumstances of your case, and therefore it is impossible to second-guess what the response will be from Atos and/or the DWP might be?

I have heard from someone who will be unable to meet the 6 week deadline. Having sent letters to DWP about this, and involved their MP:

"we have been informed that because of the large number of people requesting extensions all extensions have been barred and will be block except for those claiming under special circumstances, ie terminally ill."

Can this be challenged? Any thoughts as to what to do?

There is no legal right to an extension to the six weeks allowed for the return of the ESA50, nor is there a legal definition of what a "good cause" reason for returning it late might be, so I doubt this could be challenged on anything other than a case by case basis and only after it is returned late with and the associated "good cause" is rejected.

So - would it be better:

to return the form within the specified period, even if incomplete, including notification that too ill to complete all the questions within the alloted period?

or

to return the form late but thoroughly completed, with reason why late

If it is late they run the risk of it being rejected as a whole.

If it is incomplete they run the risk of losing points that they might require to pass the WCA.

WIth no sight of the ESA50 and no understanding of the disabilities that the claimant suffers from, how can anybody but the claimant make this decision!
