As Gordon says, unless you're CPN is a nominated representitive by you, or has been given power of atorney, the onus is not on the CPN.

By giving you're permission for ATOS to contact you're CPN, you are simply allowing ATOS to gain information re : your condition from the CPN.

It is up to you to contact ATOS re your Reasonable Adjustments, stating what they are, and why required.

You could also add that any contravention by them of The Equality Act, may result in you pursuing legal redress.

Put it in writing, as follow up to phone contact. (Keep Copies)

The decision of course lies with you.

The declaration at the end gives the DWP permission to contact any person or organization mentioned on the form.

Unfortunately Atos have a habit of ignoring a claimants request even though the form asks if you have problems with transport. It looks like you will have to contact them and reiterate what you stated on the form.

I would also consider making a complaint to Atos for ignoring your request.

Thank you both. Phone contact is not an option for me so I will write to them after I've read up on the stuff you've both mentioned. I think that was why my CPN said she wouldnt phone them as she wants me to write to them to get my point across and for them to refer back to the ESA50.

Atos phoned me about 2 weeks ago, I googled the number to find it was Atos. Today I've received a letter from them with appointment, plus the bus route, which was clearly evident in my ESA50 I can't use public transport ! They have not contacted my CPN at all. This in my view is totally out of order. Where do I stand on this ? Any advice would be much appreciated. Thanks.

Please also be aware that if you have stated in your ESA50, that you cannot use public transport, but then go on to do so, if you're still compelled to attend the ATOS centre, this will be used against you.

One of the first questions they ask is "how did you get here today"?.

So arrange other means of getting there if you need to, you can ask that they pay for a taxi door to door.

The important thing is that if the issue is not resolved before the day of the assessment, that you actually make sure you attend, otherwise they can just stop your benefit.

Thanks bro58. As i said i cant use public transport, my cpn is accompanying me and shes driving. I will have a look at the link, try and gather as much info as poss and write to atos and post it recorded delivery.
