Hello all...my name is Maggie and Im 17 months down the line after going thru breast cancer (surgery, chemo and rads), 84 days after my treatment I was called in for a back to work assessment, the girl at jobseekers promptly sent me home as I was obviously still very ill and she said she "couldn't believe" I had been sent there for an interview so early after the treatment. 156 days after treatment I was called in by Atos and was surprised at the wee girl who interviewed me discussing the case of the chap who was in before me in quite a lot of depth..[phrase removed]..anyway the outcome of the interview was...yes I received no points...even though I have been suffering from clinical depression for a long time and the chemo treatment had obviously added to the stress, I went thru all my treatment alone as I had just moved house and didn't know the neighbours..also because of a family breakdown, my two sisters decided not to help or contact me..still haven't till this day. I see a Phsycologist regularly and take major anti d's...but none of this was taken into consideration at the interview..basically if you can stick your finger up your nose and wipe your own bum you are fit to work..so they instantly put me on Jobseekers..I said "Ive got a job..(I was self employed before cancer) but I was told they HAD to put me on jobseekers !!!???
The amount of mistakes that were made in the form was laughable..she said I had had no falls..a couple of weeks prior I had fallen down a flight of concrete stairs and made a real mess of my face and broke my finger..I was wearing a splint on my hand the day of the interview and still had bruising on my face...she wrote on my form...'no recent falls'. She asked me if I had any hobbies..I said I used to horse ride and I competed in 4x4 driving competions, I like photography and crafts...but unfortunately Im not fit enough to pursue them just now..she wrote "no hobbies"...strange. Anyway something good happened.. the Scottish Sunday Mail got wind of my story and wrote a rather damning article about it last week

I always thought that nursing was a vocation...I always admired nurses, but the "nurse' and I use the term loosely that interviewed me could obviously only see £ coins in front of her...the system stinks !!!

hi maggie you contact your MP and ask him or her to contact Chris Grayling and ask Mr Grayling to comment on the fact that he as said on a number of occasions that people who are genuine would have nothing to worry about and would not be found fit for work peter

Maggie - are you going to appeal? Don't forget that you've only got a month from the decision to get your appeal in on a form GL24. Take a look at our info on appealing if you haven't already.

I don't quite understand. You cannot be placed on JSA; you have to make a claim.

After the appeal was lodged ESA payments should be restored.

Thanks all, yes I am appealing, I've got a Tribunal on the 9th of August. It's taken months and months to get this far and my advisor has told me to go through the whole document and remark on all the mistakes (there are loads, and her spelling, handwriting and grammar is so bad that I can't understand a lot of what she has written).. I'll muddle through, thank you for your advice, I need as much as I can get, Ive always been bad with paperwork x

I am sure this has been raised by your advisor, but I would rather make sure than assume.

Whilst it is really important to point out the errors and false assumptions in the medical report, doing so will not win your Tribunal!

You will only win by showing that you meet the criteria of the benefit you are applying for, so you should ensure that most of your energies are directed in showing how you meet each of the criteria and in supporting each point with relevant evidence where available.
