Hi everyone, I've missed you!

My estranged partner died recently and I was doubly shocked to learn that there will be a lump sum and pension for the children.

Will this affect my benefits even though it's not for me/not in my name.

If you are still receiving Child Tax Credit for the children, the payment of CTC will be affected if the amount of capital held is more than £3.000 for each qualifying child/young person. In these circumstances you would not be entitled to CTC, but you would still retain Child Benefit if that is payable?

It should not affect your entitlement to means-tested benefits if you receive them, if it can be adequately demonstrated that the lump sum and pension is solely for the children and not for yourself? In this situation it would be essential that you seek advice from a CAB or WRO office on a one-to-one basis, so they can check to ascertain whether or not the receipt of monies for your children, may impact on your own benefit entitlement?

There is also in this case as the money is for children she might even get legal aid to check things out the CAB should be able to give advise on this matter

Hi, thankyou for the advice. I rang the benefits enquiry line and they were useless!

I think I may try for legal advice as I don't want the children to have the money until they are older anyway!

I am loosing maintenance now which will have a serious impact. Not sure how to cope with that.

I am sorry about the death of your estranged partner & father of your children. It must have been a very distressing time for you all.
I do hope you are able to access some good advice/representation. It may well be that because you are losing maintenance you are entitled to extra income related benefits?
