Lisa,

Because of you I am now having second thoughts about an appeal. I received an appointment(first of 5) at the same time I was made aware of being in the WRAG group.

It takes place this Wednesday. I will call for my medical details (thanks again Bro58) and at the appointment I will pick up the GL....?? 34?/appeal form. Once i have my report, I will judge whether or not they have been fair to me in terms of points awarded and go from there.

Hello Everyone,

I promise you that I tried to find the answer to my question first, but no joy. I'm a sure it is here but, well, I tried.

Would someone kindly tell me who/where to call to request a copy of the results of my medical with Atos? I am told by Bro58 that it is the ESA85 that I am after.

I am thinking of appealing to be put in the Support Group instead of WRAG and feel this document will help me make a good decision.

Contact the JCP/BD office who deal with your ESA claim, and ask them to send you a copy of the ESA85.

Hi, cmarie

From your previous posts I know what a crap time you had at your assessment. So it seems highly likely the ESA85 will contain all sorts of rubbish (so your attitude of being prepared for the worst will come in handy!)

You are clear you should be in Support Group, so you know which SG criteria you satisfy. Check the ESA85 specifically for those inaccuracies which meant the Decision Maker at DWP didn't have the necessary info. You may want to correct these in your appeal statement. (If you try and refute every error you'll have to write a very VERY long statement!!!)

Definitely worth stating in your appeal that you satisfy XYZ criteria for SG. Include supporting statement from medical persons (if not already sent). The decision maker is meant to review the decision on receipt of your appeal, and might change it if given the right evidence, in which case you won't need to go on to an appeal hearing. (A long shot, but it does happen.)

I know the thought of appealing is daunting, but remember 
(1) most people seem to report their appeal panel were respectful and keen to understand the REALITY of their condition  
(2) it's taking months to arrange hearings so you have time to get your strength and courage back 
(3) you can withdraw your appeal later at any stage if you want
(4) you don't have to attend the hearing although it does increase your chances (statistically) of winning. I'd recommend opting to attend in the first instance, you can change your mind later.
