Hi Derek,

A quick question, by them not ticking the box, does that actually mean that they have not requested or received any evidence from the G.P.?, or does it actually mean that they have, and treated it as irrelevant ( not considered it).

I was just thinking of the G.P. letter of 4 lines that QL paid £20 for, G.P. does not seem overenthusiastic about providing support.

Could QL, actually ask ATOS whether they did receive evidence from the G.P.?, and if so obtain copy of it

Hi Bro58

If I remember correctly (unfortunately the thread has disappeared but QL will correct me if I'm wrong), the £5 per line letter was obtained after the decision and in support of an appeal.

I think the tick box can refer to either an ESA113 or any other evidence from the GP and it would have to be ticked if they considered evidence.

If they received evidence from a GP, even it it was irrelevant they still have a duty to consider it before deciding that it's irrelevant, so I suspect that if the box is not ticked the decision maker did not have any medical evidence from the GP in front of him when making the decision.

Bro 58 I know for a fact that they have not contacted my GP because when I asked him for a letter he said that the DWP would contact him for more information, but to date they still had not. So I think thats why he did not go into much detail in my letter.

If that's the case your doctor needs to realise that you are the patient and not the DWP!

Especially when he charged you and would not be receiving a fee from the DWP!

Bro58, I forgot to comment on your last paragraph. If a GP has sent an ESA113 or any other letter it should be easily obtainable from the patients notes.

Derek,

I think you are correct in the timing of the 4 line G.P. letter.

The point I was trying to make, is that if the G.P., was that way inclined, (not very supportive), maybe any evidence that the G.P. provided was minimal, and also not very supportive, therefore did not help in QL's claim, all speculation I know.

Therefore, QL would be made aware of such a scenario, by requesting said info from DWP/ATOS.

This could help her understand the decision, and if her G.P. is "on side"

I have an appt to access my notes 16th Aug and 18th Aug I have another appt to see my GP and then face to face I will ask him for another letter as I was not happy with what he wrote just saying my conditions which are Spondyliosis of my neck and back, Deppression and under the Gynaecologist for Endometrial Carcinoma. And in view of these conditions I was not fit for employment. No mention of how all this affects my daily life.
