Hi all. New poster here but regular reader. Be gentle with me.
I applied some years ago for DLA but was unsuccessful. I recently applied again as my conditions had gotten worse. I got the "Dear John..." first refusal letter and on reading it was shocked. The decision maker seems to have ignored most of what I had put on the form. I had used the excellent advice from this website to complete the form.

I telephoned the DWP and spoke to a person who asked if I wanted a review of the decision. I agreed to this and again emphasised what was wrong with me.

I got another "Dear John ....." letter stating that the original decision was upheld, much to the surprise of my GP. I contacted them again and asked for the appeal form. I have also updated my file with relevant changes to my circumstances.

I completed the appeal form practically verbatim from this website and await the outcome. However, and here is the question I was coming to, I was asked to contact Welfare Rights to help me at appeal and so got in touch with Warrington MBC only to be told that Welfare Rights don't represent any more. It was down to CAB. I have been trying for a month to get in touch with CAB but they don't answer the phone.

Any advice offered would be welcome. Sorry it's a bit War & Peace.

Hi Pete

I'm afraid it is extremely difficult to get representation nowadays, and the cuts to Community Legal Service will not make things any better.

I believe most CAB offices no longer provide representation but not all. If you are unable to contact CAB you could try other organizations at the link below.

If you are unable to obtain representation many appellants are still successful turning up to the hearing on their own or with a friend for moral support.

Hi Pete I have no advice sorry. I am in the same position as you. The information I provided did not seem to have been read. I have applied 3 times and been turned down even after using the excellent advice on this site. At the mo I am trying to decide whether to make yet another new application as ESA have now put me in the support group. I am wondering if it might help a new ap. Good luck with yours

Hi Pete I have been trying to contact CAB too , to no avail, so my husband and I have decided we will do it alone and he is going to represent me (don't know yet if that is acceptable) but he says he is the best person to stand up for me as he knows what it is like living with my problems on a daily Basis.

Hi QL

You're entitled to nominate anybody as a representative, but unless your husband is knowledgeable abut benefit law it would be best if he does not take on the role of a representative.

You can tell the Clerk to the Tribunal who will speak to you before the hearing that he is present as a witness and would like to speak. The tribunal should be interested in any oral evidence he can give.

Thanks for that information, no my husband is not knowlegeable on benefit law, but very knowleageable of my conditions and the difficulties I face every day, so yes we will take up your advice. Very much appreciated.
