The letter to which you refer appears to be a notification of your ESA award at the WRAG rate, and if the information to which you refer is in the 'payment breakdown' section which is normally on page 2, then it it is unlikely to be a review date, but an arbitrary date plucked out of thin air for administrative purposes.

Form ESA85A is actually used both for cases where there is no face-to-face assessment to decide further ESA entitlement beyond the assessment rate, and also for claimants who are found to have eligibility for the SG, as demonstrated in Appendix 3, on page 171 of the WCA Handbook (March 2011).

Therefore in the circumstances as described the OP needs to request the ESA85A.

O.K., Nada,

From information gained thus far, from the MODS input,

The general consensus is that the date on your letter should not be taken as your expected review date.

Therefore, if you wish to gain a better indicator of your expected review date, I suggest you do the following.

Send a letter, (Keep Copy) to the Decision Maker, at your local benefits office (BDC), this should be the address on the top of the letter that you mention.

State that you request copy of The Medical Report, which could either be an ESA85 or an ESA85a, which contains your "Prognosis" Expected Date of Review.

(Use the above wording)

This will cover the use of either report form.

You could also request copy of your "Written Statement of Reasons", ie ESA65 form.

You could back this letter up with a verbal request over the phone if you wish.

Thanks CD, for taking the time to confirm that it should be an ESA85a that Nada requests.

I am also clear now for future reference.

Where's "That Derek" when you need him?. LOL !!!, as I said it was he, who I first gained the info from.

So Nada it's DEFINATELY an ESA85a that you need.

Hi,
I was placed in the WRAG in May11 following my migration from IB.
In the letter informing me of the decision it stated that my payments would be from 28th june to the 28th November.
When i rang JCP nobody could tell me what these dates meant.
I was then sent an ESA72 which is a preprinted letter with a tick in the box next to the WRAG information box.
However at the end of the letter it says my claim will be reviewed on 25th May 2012,and that i may be sent a new questionairre or be called for a medical.
I contacted my MP about these dates as well as other problems with the way the assessments are done and she has written to Chris Grayling (Works&Pension Minister) asking him for an explanation.
My MP said she had to allow DWP 28 days to deal with request, this period is now up and she is going to chase them for an answer.However she did warn me the wheels of government turn very slowly.
I will let you know when i get a answer.
