I am going to appeal ( prob Dec 2011 before hearing )and have found out the Dr who assessed me has already had a warning for similar ommisions as my medical.Should I disclose this fact to the Tribunal or will it be frowned upon to bring it up

i told the doctor at my appeal that the physio who put me through the atos assessment had very little regard for the truth,but i dont think it went down to well. profesional people tend to think they are all above such things. ( but then they work for atos)

You will find professional groups such as DRs stick together, you will find it hard to find a DR to speak out about another DR. But it has happened, when l was working l work as a professional One thing we do not like is fact

Remember, above all else, that your goal is to convince the Tribunal that you qualify for ESA by meeting the criteria (descriptors). Part of that may be to tell them where the ESA85 medical report is wrong, but you must then show them the true situation and that's where you must concentrate your efforts.

Regarding this doctor. Have you made a complaint to ATOS? That is probably the most relevant place to report his unprofessional behaviour. The tribunal cannot do anything about him. If everyone he mistreats makes a compliant to ATOS something might get done. And, at the very least, it will boost the ATOS complaints figures!

Can I ask HOW you have found out about his previous warning? Is it "on the record"? (By which I mean can you name the person who told you and are they reputable? Or is it perhaps publicly available info?) If so I'd say it's probably worth mentioning at the tribunal but not making a meal out of it.

You can say something like "The medical report omits crucial relevant information about X, Y and Z. I'm not sure if this is admissible, Mr Tribunal Chair, but I have evidence that the Doctor has been warned about similar omissions in the past." The Chair may well say "That's not relevant." In which case say "Oh. Sorry." and move on quickly. The point has been made. Get back to telling them your true situation.

Thanks for replies and think might just keep quiet about it and concentrate on showing how i fit the descriptors.
Have already put complaint in to ATOS about the Dr s attitude and incompetence and also informed my MP who ATOS now say they must correspond with instead of with me.
Incidentally I found out about Dr already having a warning by putting his name into GMC register and it showed upon there.I have printed this info off just in case I do decide to use it in the future.

if you know a drs name you can check his details at the gmc site IF he has been reported for anything and it causes concern it will be noted on his recorded even if nothing proved

for example the common one is a female complains about a dr and his record will show that he has to have someone in the room to see a female... nothings been proved but questions asked and you find no record on the gmc site as thats belive it or not not that serious

more serious will show the results of any investigation and action taken re training working under another dr or removed from the register for a period of time or for good
