Don't wait until after the appeal hearing if a medical condition worsens, which no doubt could happen in the greater majority of mental heath problem cases. A claim should be made immediately irrespective of the extent of the deterioration, as it would in my view be essentially a subjective decision as the the actual level of deterioration?

If ESA is not awarded beyond the assessment rate on the second claim, it can be appealed in the normal way.

Thanks guys. Sorry if i'm coming over as thick, I just can't take things in (a symptom of my illness?). Can I just get this straight - i can make another claim before 6 months? Really sorry for being annoying.

Don't worry about it.

As I said in my previous post, the rules can be confusing. so this answer excludes the situation where a claimant has been found Fit for Work due to a technical infringment.

You can make a new claim for ESA within six months of a Devision that found you Fit for Work, providing you can show;

- A demonstrable deterioration in your current condition, or

- A new condition, which in its self, would result in you being found Unfit for Work.

Even though you can submit a new claim, you will only receive one payment for ESA.

Hope this explains it.
