Hi Mods,

Just been printing some info off to take to my G.P. this afternoon to request support in my IB to ESA Migration.

I noticed the extract below, now, I have not needed a Med Cert for 10 years, in that time I have had 6 or 7 G.P.'s and not had a Med Cert of any, as were PCA exempt.

So even though my G.P. has never issued me with a Med Cert, is he still contractually obligated to provide reports, ESA113, etc, to DWP/ATOS.

Contractual Obligations
3.1.1
General Practitioners
There is a contractual obligation for any GP who has issued a Med3 (certificate of incapacity for work) to provide medical reports in relation to Incapacity Benefit and Employment and Support Allowance. This should be done free of charge as covered by the contractual arrangements between GPs and the relevant Primary Care Trust.

With regard to the advisory document from the DWP to G.P.'s, on the link below :

See extract below from top of page 12 of the document. :

DWP Medical Reports – A Guide to Completion 12
In addition, the Access to Medical Reports Act does not apply to reports for benefit purposes3 and you do not have to discuss with or show the information to the patient before you send it.
3.2.2
Release of Information
Information (including medical reports) will be made available to patients on request or if they appeal against an unfavourable benefit entitlement decision. Harmful information (see below) is the only exception.

With reference to the above, we were having a discussion on the Forum a few weeks ago, and I said that I could not see any reference on my G.P. medical fles going back 10 years, to any report request, or reports from my G.P. for the DWP. I found this hard to beleive.

I think it was Derek who said, that any medical report that your G.P. made would be on your files, I am now wondering if the info in the doc above accounts for there not being any reference to DWP reports on my files, and I would have to access such reports from the DWP, and not my G.P.

Any clarification here would be much appreciated.

Hi,

Just found the thread, and post by Derek that I mentioned in my previous post, here :

So if Derek is correct, that would imply, that the DWP have not been in contact with my G.P. for the past 10 years ?.

I know I have been PCA exempt for that period, but find this hard to beleive.
