Good news regarding DLA, partner got his dla back pay almost £2000....

Now the bad news....

Six weeks almost now since my partner won his ESA appeal and was placed in support group.
Phoned ESA yesterday for an update on what was happening and was told that his payments have gone up to £94 a week and he is now in wrag (Excuse me while I scream)
we requested a call back from Glasgow (our local office?!?!) we live in Essex!
Was told that he is in wrag, we pointed out that we have a copy of tribuneral descion and states clearly support element, we had sent them a fax 4 weeks ago to Glasgow, but the person on the phone told us they don't read faxes!!! :blink:
So now we have to wait again so they can check to see which group he is in..
I'm thinking the whole DWP is run by incompitent idiots!
After two years of fighting and winning the appeals for both DAL and ESA the merry go round goes on and on.....

If they don't get a move on, get your MP on to it. They have people at the DWP who specialise in dealing with MPs so MPs can really get things moving.

I've just sent a stinking letter to the cheif executive at DWP, it's going to make his eyes sting when he opens it.
I'm fuming that this is still going on.
Says on their guide lines that they have to update their claims as soon as possible....six weeks and counting....Soon as possible my eye!

Well done TA, that's the spirit!, "make em ave it".

They are very quick to make "US" jump through hoops, but are far more reluctant to stick to their own guidelines and best practices.

So it is up to "US" to turn the tables, and force them to, by any means that we can.

Had a call from the ESA clerical department re my partners claim, he won his appeal on June 28th and was given paper work saying he is in the support component.
ESA say they have paper work saying he was placed in wrag.
I called the tribuneral service and they said he has been placed in the work component, but they also said the ESA would have been given the same paper work as us with clearly states support group?!?!?!
Is it me, am I going mad?
The lady at the tribuneral service said it sounds like he should be in support group because of his severe angina.

We have an appointment on monday at local JS so they can once again fax the paper work over that we have.
We did fax a copy but apparentley they don't read faxes.

Now were told by the clerical officer at ESA that we will have to appeal the decision ? so we have to appeal a decision that we already have?

Oh my head is spinning...
Any advice from the mods please..

I haven't seen one of these Tribunal notices, but does it say why your husband is in the Support Group, e.g. which of the Support Group criteria he met.

Failing that, you can ask for the Statement of Reasons from the Tribunal which should detail the criteria he met, however this could 5-6 weeks.

Turning things around, try and get a copy of the notice that the DWP have. You need to understand whether it is the same, but they are reading it differently, or it is completely different, as the actions you need to undertake will vary on the result.
