I have been on ESA Cont based since being retired by ATOS on health grounds from the civil service. I recently completed a renewal ESA questionnaire which took me 7 weeks to do because I have numerous medical issues and did not want to miss anything out.
I have today been called for an appointment with a Personal Advisor at the Jobentre to give me advice on getting a job. I understand from her ATOS have put me in the Work related group but have said that I should not be seen again for 18months Dec 2012???? I received no paperwork from ATOS or the Benefit Centre about the decision and am now out of time to appeal
I don't know what I scored on various descriptors and the Personal Advisor said I should be in the support group and to wait until 2012 and then if its the same decision appeal. Can you appeal late?????? and does it have to be on form GL24???? :woohoo:

It would be advisable to write to the DWP and ask for a copy of the formal decision letter which placed you in the WRAG for ESA purposes.

In order to lodge an appeal outside the one month time limit, you will need to show good cause why you didn't appeal in time. Non-receipt of the formal decision letter should amount to good cause, but you may be required to demonstrate that you did not receive it?

Late appeals can be accepted up to thirteen months following the date of the decision, and although the normal practice is to make an appeal on form GL24, the DWP may accept an appeal by letter as long as you make it abundantly clear that it is a notice of appeal. This can be done by heading the letter in red with the word 'Appeal.'

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Appeals should be treated justly and fairly. If some of this is not your fault dont worry unduly.
Reasons for delay can include.
1.You did not receive the decision
2.You made a reasonable mistake in calculating the time limit.
3. You were ill.
