Coleen,

Being put straight into the WRAG is quite a common occurance.

As Gordon has advised if you have a look in the Employment and Support Allowance resources on the left, and decide that hubbie fits the criteria and descriptors to be placed in The Support Group, you can appeal.

Hi, your hubbie didn't have an Atos Assessment?

Can't believe they put him in the WRAG!!

Definately appeal, this is ridiculous!

Hi Connie,

Even though some limitations that will give an award of DLA, could also be relevant to ESA assessment, DLA is a totally different allowance, and therefore will not be taken into account is assessing for ESA.

However is certain circumstances, they can use evidence from one assessment,in helping to decide the other. e.g. If there was evidence from a recent ESA assessment that somehow contradicted allowance of an award of DLA, or visaversa.

When you say that your husband received high rate DLA, are you referring to the care component?

If so, he would have been exempt under the old Incapacity benefit PCA regulations, and therefore to be transferred to the WRAG given his health conditions would appear to be anomalous, although I must stress that under the ridiculous ESA regulations where there are very few exemptions, this can happen.

I can only reiterate what other members have previously said in this thread, and if you both think he should be in the support group then consider an appeal, possibly after taking face-to-face advice from a CAB or WRO if that is an option you are able to consider?
