The Transitional Protection lasts as long as he continues to be eligible for ESA(CB) or until 2020.

I am in receipt of a small pension less than £85 a week and the tax office added the annual pension to what I was recieving in ESA together and I pay tax on the difference which is deducted from my pension

That's not quite the way it works :)

HMRC add your ESA(CB) and Pension together then they deduct your personal tax allowance, you are then taxed on whateve is left. Any tax payable is deducted from your Pension.
