hi, my hubby recived a letter been turned down for dla again thats twice now they wrote to his gp so its him thats let him down he knows all hubbys probs osteoarthrtis, depression, epilepsy , and now he has to see another specilist as he is showing signs of raynauds disease i feel [edited part sentence] he just cannot be botherd to go threw the report properly, does anyone know how long he will now have to wait again to put a fresh claim in for dla ?? thanks

I'm not aware of any period being required before a new claim can be submitted, so you should be able to just phone the DLA unit in Blackpool and start a new claim.

A claim for DLA can be submitted immediately, and it can run concurrently with an appeal should your husband wish to challenge the adverse decision?

Its not just the medical conditions your husband has, but the help he needs, (whether he gets that help or not). If making a new claim you must spell out what help he needs.

You could ask the GP for a copy of the form the GP completed for the DWP, so you can see for yourself, or appeal on form GL24, which will firstly lead to a reconsideration, and eventually sent to appeal tribunal, you will then receive a "bundle" of papers including the GP's form, but without supportive evidence its unlikely to be overturned. (You can withdraw your appeal at any time).

You could make an appointment with your husbands GP and explain the help he needs, now that the GP has referred him to specialists. Any letters of support should be included in your new claim or appeal (recondideration) spelling out the help your husband needs. Please note the time limits for appealing.
