Unfortunately I have my 'medical' tomorrow! :( (which I am absolutely dreading). I intend to write to BDC (or should it be JCP?) to ask for ESA65/85 - can you please tell me the soonest I could write to them? Could I come home tomorrow from the assessment and write to them, or should I give it, say, a couple of weeks? Also, is ESA65/85 the only things I should ask for, or is there anything else? thanks

An ESA65 will not be produced until the decision maker rubber stamps the ESA85 makes the decision.

Although the ESA85 will be produced in the time it takes you to leave the building, JCP will always refuse to release it until a decision has been made.

It is possible to make a Subject Access Request under the Data Protection Act for the information but as it can take over 40 days to receive the information, unless you are one of the few claimants who are kept waiting a very long time for a decision, it would not be of much use.

Good luck for tomorrow.

Derek

Hi Derek,

What are you still doing up at this time of night?

You are absolutely correct in your advice.

Although you're not entirely correct in the medical report being potentially available before you leave the building. :P

See a thread re this very long medical on rightsnet :

Just as well Atos HCPs don't get paid by the hour!

Obviously the HCP hadn't mastered using LiMA.

On this occasion, you could never accuse the ADA of not carrying out a thorough medical assessment, and then subsequently taking his/her time to finalise the ESA85 report, when it took well over a week to complete the assessment from start to finish!

Yes CD, :)

It's a wonder the claimant didn't receive a new ESA50 to fill in, before the report mentioned had been finalised.
