I think you have taken my original post out of context.

IB, IS, ESA, and DLA are all seperate benefits.

Everybody on IB and IS due to ill health are being transferred to ESA, you DLA is not affected by these changes.

To try and answer your questions.

1. No

2. If you receive IS due to ill health then you will continue to do so until the transfer is completed.

There is no assessment phase for claimants being transferred to ESA.

If you are succesfully transferred your payments will not be less than you currently receive.

As already recommended, you should have a look at the ESA guides in the Members Only area.

If feasible, we would also recommend you seek help from your local CAB or Welfare Rights office.

I have been sent the letter that I am to be transfered from IS and DLA to ESA, and will shortly be sent a form.

From your post it sounds that DLA is discontinued during the assessment process, and the entire benefit package of IS/DLA is replaced with an ESA assessment rate equivalent to JSA.

I find this difficult to understand, as award letters clearly state what amount will be received (italics) because this is what the government says you need to live on.

Are people expected to be able to live on less just because of the fact that they are being transfered to a new program or assessed for qualifying for a new program?? I could understand that logic if individual circumstances change for the better someone might be able to live on less, but a change in program is not a change in individual circumstances?

Welcome to B&W. DLA is a stand alone benefit and is not connected to other benefits in the way you suggest (as far as we know!).

I am not sure what you mean by not being able to answer specific questions, only general ones, as I have read many posts about people's individual circumstances that were answered with replies directed to their individual experiences and situations.

In any regard, perhaps it would help me to understand the rules of 'transfer' if I were to rephrase my questions in general terms.

1. Can claimants currently in receipt of DLA, as the result of a successful IB50 application, and who only receive an additional component of Income Support expect a notice of transfer from IS/DLA to ESA to be inclusive of a reduction of benefit to the ESA Assessment Rate?

2. Is a transfer from IS/DLA (awarded as the result of a successful IB50 application) to ESA considered to be a 'fresh application' to ESA, or is it considered to be a move from one benefit to another?

I understand your concern that as a new member you are concerned that B&W Mods can not answer specific questions about your benefit claims.

However, as we don't have the full facts of your case, we can only give general answers. It would be dangerous for us to give specific advice, without being able to have these facts, as we may well give wrong advice.

This is why we suggest that members seek face to face advice, with say, a Welfare Rights Adviser.

DLA if awarded, is not affected by claims for other benefits. We have heard of ESA reports being used, particularly at Tribunals as evidence, but we have no hard evidence that this is s general rule as yet.

I'm sorry I can't go into further detail.

After another look at some of the pages here at bw, I did find answers to my questions about IS and transition to ESA here:

I didn't think to read this link titled Forced move to ESA – your transfer date revealed, because the title didn't appear to have any relationship to IS/Dla claimants and the process of transition.......until I read through it.

In future, I will be aware that there is more info on benefits and work on this site than first meets the eye!

I've been waiting since Feb this year to be migrated across to ESA. That is, my IB award was due to be looked at again in Feb 2011. So one would have thought I'd be first in the queue for migration onto ESA. However, different Jobcenter offices work at different speeds with different rules. So there are no hard and fast rules.

I try to be pragmatic about it. Each morning the ESA form does not arrive is an extra day to concentrate on getting better rather than completing lengthy forms.

Another option is to award youself a large box of chocolates when the form arrives (sugar helps brain function - therefore helps form filling) :)
